Colby Surfboards — terms of sale
Effective 17 September 2026. These terms apply to orders placed through the Colby Surfboards online store for delivery within South Africa. They do not limit any rights under South African consumer law.

Prices and payment
Prices are in South African rand. Full payment is taken through Payfast at checkout. Standard and custom dimensions have the same listed price for the selected model. Courier delivery within South Africa is R600 per order; review the complete checkout total before paying. We will not add an undisclosed custom-size surcharge. Separately requested extras must be quoted and agreed before they are charged.
Your board and order confirmation
Review your model, dimensions, fin system, quantity, address and total before submitting payment. You can correct these in the cart or checkout. If you are unsure whether fins, artwork or another extra are included, ask Kevin before ordering.
Boards are made to order. We confirm your selected specifications with you before shaping starts. An automated order confirmation records your order; it does not mean shaping has started or that a requested specification has been approved. If a specification cannot be made, we will discuss alternatives before starting. If no acceptable alternative is agreed, we will cancel the unstarted order and refund it in full.
Keep your order confirmation and a copy of these terms. Contact Kevin with your order number if you need an order copy or correction.
Production and delivery
The checkout courier estimate of 5–8 business days is transit time after dispatch, not shaping time or a guaranteed order-to-delivery period. Contact Kevin before ordering if you need a board by a particular date. A different fulfilment period must be expressly agreed with you; making a board to order does not by itself extend the statutory delivery period. Where ECTA applies, the default is fulfilment within 30 days of receiving the order unless otherwise agreed. Statutory cancellation rights for late delivery remain available.
Provide an accurate delivery address and contact details. Contact Kevin about a delayed, missing or damaged parcel. Photos of damage and packaging help us investigate, but failure to supply photos immediately does not remove your statutory rights. Workshop collection must be agreed directly; do not travel without confirmation that the board is ready.
Changes, cancellations and returns
Request a change or cancellation as soon as possible by email, quoting your order number. We will explain what is feasible and any proposed effect on price or delivery before proceeding. There is no blanket forfeiture of payment: any lawful cancellation charge must be explained and justified in the circumstances.
Where ECTA's cooling-off right applies, you may cancel within seven days after receiving goods without a penalty, apart from the direct return cost. The refund is due within 30 days of cancellation. The statutory exception for goods made to your specifications or clearly personalised may apply to genuinely customised boards. A standard catalogue board is not automatically excluded merely because it was made after ordering.
Faults and incorrect specifications
Personalisation does not remove statutory rights for defective goods. Where the Consumer Protection Act applies, goods that fail its quality standards may be returned within six months of delivery, at our risk and expense, for your choice of repair, replacement or refund. If a repair fails or a further defect appears within three months after repair, the Act provides for replacement or refund. These rights are additional to other applicable remedies.
Contact Kevin if a board is faulty, unsafe or differs from the agreed specifications. Describe the issue and include your order number. We will arrange the appropriate next steps and confirm the return destination. Normal wear, accidental impact, misuse and heat damage are not automatically manufacturing defects; each claim is assessed on its facts without excluding statutory rights.
Refunds and complaints
Refunds are made to the original payment method where practicable and within the applicable legal deadline. Bank processing times may affect when funds appear. Store credit will not replace a money refund where the law entitles you to one.
Raise complaints with Kevin using the contact details above. You may also approach the Consumer Goods and Services Ombud where it has jurisdiction, the National Consumer Commission or another competent body. South African law applies, without removing mandatory consumer protections or access to courts.
Privacy and changes to these terms
Our Privacy policy explains how personal information is handled. Never send full card details by email. Changes to these terms apply to future orders and do not retrospectively reduce rights under an existing order.
